EB-5 timeline and processing
The milestones in an EB-5 case, who controls each one, what visa availability means and where USCIS publishes current processing times. A general guide with no timelines. No offering is being made on this website.
Overview
Milestones, not dates
An EB-5 case moves through several milestones, and different parties control different ones. This page lists them in order, says who controls each and explains two ideas that decide when a visa can be issued: visa availability and country of chargeability.
You will not find durations here. Nobody can state a reliable timeline for every case, and a figure on a web page goes out of date quickly. The place for current figures is the USCIS processing times page, which lists each form separately.
Milestones
Six milestones from first conversation to removal of conditions
-
Next
First conversation and screening
The investor reads USCIS guidance, engages their own immigration and securities counsel and checks that the source of funds can be documented.
-
Next
Preparation of funds and documents
Counsel and the investor collect identity, tax and bank records and build the path of funds. Translations are ordered.
-
Next
Project application by the regional center
The regional center files Form I-956F for the project. Eligible investors receive offering documents from the new commercial enterprise after that filing.
-
Next
Investment and Form I-526E
The investor places capital in the new commercial enterprise and files Form I-526E with USCIS, with evidence of the investment and the lawful source of funds.
-
Next
Visa availability and conditional residence
After USCIS approves the petition, a visa number must be available. The investor and eligible family members then apply for a visa or for adjustment of status and receive conditional permanent residence.
-
Next
The conditional period and Form I-829
Near the end of the two-year conditional period the investor files Form I-829 to remove conditions, showing the investment was sustained and the jobs were created.
What unlocks the next step: Each milestone depends on the one before it and on a decision by someone other than the investor.
Roles
Who controls each milestone
Parties in a case and what each controls
| Party | What they control |
|---|---|
| Investor | Gathers records, decides whether to invest, transfers funds only on counsel’s written advice and files forms with counsel. |
| Investor’s counsel | Advises on eligibility, prepares Forms I-526E and I-829 and reviews the offering documents. |
| New commercial enterprise | Receives investor capital, deploys it into the project and keeps the records investors need. |
| Regional center | Files Form I-956F for the project and keeps its designation in good standing. |
| USCIS | Decides each petition on its own merits and publishes processing times. |
| Department of State | Allocates visa numbers by category and country and publishes the monthly Visa Bulletin. Consulates issue the visas. |
The forms named here are set out in the USCIS, EB-5 Questions and Answers.
Visa numbers
Visa availability and country of chargeability

Approval of a petition and the availability of a visa are two separate events. USCIS decides the petition. The law caps the number of EB-5 visas each year, and it also caps the number for each country. When more people are waiting than there are numbers, a petitioner whose petition is approved waits for a number.
The country a person is charged to is called the country of chargeability. It is usually the country of birth, with some exceptions that counsel can explain. The Department of State publishes a monthly Visa Bulletin showing which dates are current for each category and country. Reserved visas for rural and high-unemployment projects, described in the targeted employment area guide, have their own lines.
Because visa availability depends on demand from other people in the same country, an investor cannot predict it from a single case. Ask counsel how the current Visa Bulletin looks for your country of chargeability and what has changed recently.
Current figures
Where to check processing times
USCIS publishes processing times for each form on its USCIS processing times page. Check the form, such as I-526E or I-829, and the service center. Rural petitions receive priority processing under the Act, so read the notes on the page that apply to your category.
Treat a published time as a statement about recent cases, not as a promise about yours. PacinfraX does not repeat or forecast these figures.
Authorization
What changes after September 30, 2027
The Regional Center Program is authorized through September 30, 2027. Reauthorization is a matter for Congress and is not assured. The amounts also adjust: Amounts adjust automatically on January 1, 2027 and every five years after that, following the consumer price index, under the Act.
If Congress does not extend the program, the position of petitions filed before and after that date depends on the statute’s terms and on any later law. The current USCIS page on the EB-5 program reports the current status. Do not plan around an extension. Ask counsel how the date affects your own filing plans, and read the risks page alongside this one.

Questions for your counsel
Use these questions with your own immigration counsel. They are general and do not replace advice on your facts.
Show the questions
- What is my country of chargeability, and how does the current Visa Bulletin look for it?
- When in the sequence should I transfer funds, and what conditions should be in place first?
- What is the plan if processing is slower than recent figures suggest?
- How does the program’s authorization date of September 30, 2027 affect my planned filing date?
- Who in my family can be included in the petition, and what changes if a child reaches a certain age before the visa is issued?
- Which of the milestones depend on the regional center, and what happens if its designation changes?
- Which documents will I need again at the Form I-829 stage, and what should I keep from the start?
Short answers
Frequently asked questions
How long does an EB-5 case take?
It varies by form, by service center and by the investor’s country of chargeability, and nobody can promise a date. USCIS publishes current processing times for each form. This website does not state them.
Does approval of my petition mean I can enter the United States?
Not by itself. A visa number must also be available in your category and country of chargeability. After that, you apply for a visa or for adjustment of status, and conditional permanent residence follows.
Can I invest first and file later?
Counsel decides the order for your case. The usual sequence in this guide places the regional center’s project filing before the investor’s Form I-526E, and counsel advises when to commit funds.
What happens at the end of the conditional period?
The investor files Form I-829 to remove conditions. It shows that the investment was sustained and that the required jobs were created. USCIS then decides the petition.
