EB-5 questions and answers
Plain answers about the EB-5 program, the per-project structure, the process, the risks and how investor relations works with investors and advisors. No offering is being made on this website.
The program
What is the EB-5 program?
EB-5 is a US immigrant visa category for people who invest in a new commercial enterprise that creates at least ten full-time jobs for US workers. It is administered by USCIS under the EB-5 Reform and Integrity Act of 2022.
How much must an EB-5 investor invest?
Under the Act, the standard amount is $1,050,000, or $800,000 for a project in a targeted employment area or an infrastructure project (amounts read on November 2, 2026). The amounts adjust automatically on January 1, 2027. Always check the current figures on the USCIS website.
What is a targeted employment area (TEA)?
A rural area or a high-unemployment area as defined by the Act. Rural means outside a metropolitan statistical area and outside any city or town of 20,000 people or more. A high-unemployment area is a census tract with unemployment of at least 150 percent of the national average. Whether a given project qualifies is determined through the regional center filing, not by the developer.
What does "rural priority processing" mean?
Under the Act, USCIS prioritizes the processing of petitions for rural projects, and 20 percent of EB-5 visas each year are reserved for rural investors. Priority processing is a feature of the law, not a promise about any particular case.
What happens after September 30, 2027?
The Regional Center Program is authorized through September 30, 2027. Reauthorization is a matter for Congress and is not assured. Investors should discuss this with their own counsel.
How many jobs must an investment create?
At least ten full-time jobs for qualified US workers for each investor. In a regional center project, indirect and induced jobs estimated by an economic model count toward the ten, in addition to direct jobs.
What is the difference between a direct investment and a regional center investment?
In a direct investment, the ten jobs must be direct jobs created by the investor’s own enterprise. In a regional center investment, the investor puts capital into a new commercial enterprise connected to a USCIS-designated regional center, and indirect and induced jobs also count.
What is an infrastructure project under the Act?
The Act sets aside 2 percent of EB-5 visas each year for investors in infrastructure projects, and the reduced investment amount applies to them. Whether a particular project qualifies is decided by USCIS in the project filing, not on a website.
Do the investment amounts change in 2027?
Yes. Under the Act, the amounts adjust automatically on January 1, 2027, and every five years after that, following the consumer price index. Check the current figures on the USCIS website before making any decision.
Structure
What is a regional center?
An organization designated by USCIS to sponsor EB-5 projects, which allows indirect and induced jobs calculated by an economic model to count toward the job requirement. PacinfraX would select a regional center for each project with counsel; the fund for each project is identified in that project’s offering documents.
What are the parent company, the project fund and the project company?
PacinfraX Corporation is the parent company. For each project, a project fund (the new commercial enterprise) is formed, in which EB-5 investors in that project would hold their interests, and a project company (the job-creating entity) builds and operates the campus. Legal entity names, state of formation and documents are provided to eligible investors in the confidential offering documents.
Will every project use the same fund?
No. Each project would have its own new commercial enterprise, so that investors in one project hold interests only in that project.
How do you choose a regional center?
Project by project, with counsel. The regional center’s approved geographic area must cover the site, its experience should fit the state and the type of asset, and its compliance record with USCIS must be sound. The choice is made for each project, not once for the company.
What is the relationship between an NCE and a JCE?
It is one-to-one in both directions. Each new commercial enterprise lends to or invests in exactly one job-creating entity, as structured for that project, and each job-creating entity takes EB-5 capital from exactly one new commercial enterprise.
Are the project funds already formed?
No. Each fund would be formed when its project is structured; none has been formed. Entity names are not published on this website and are provided in the offering documents.
Why does each project have its own entity?
It keeps capital, records and reporting for each project separate, and it lets investors, agents and counsel review a familiar set of documents and roles each time. Under the Act, EB-5 capital is held in a separate account for one project.
Projects and states
Is a PacinfraX project in a TEA?
We do not state TEA status on this website. Any TEA determination will be documented in the project filing and shared with eligible investors in the offering documents.
How are jobs counted for a data center campus?
For a regional center project, an independent economist estimates direct, indirect and induced jobs from construction spending and operations, using a model accepted by USCIS. We do not publish job estimates on this website; the methodology and figures belong in the offering documents and the regional center filing.
Is any project currently offered to EB-5 investors?
No. No offering is being made on this website. US projects could be structured for EB-5 capital through a separate fund for each project. If that happens, any offer will be made only through confidential offering documents to eligible investors.
Which states?
Texas (South ERCOT) and a powered industrial site in Minnesota today. Additional states are under evaluation and would be named on this website only when a project is confirmed.
Do the Vietnam campuses take part in EB-5?
No. EB-5 capital goes into a US new commercial enterprise and supports jobs for US workers. The EB-5 pages of this website concern US projects only.
Process
How long does the EB-5 process take?
Processing times vary by form, by category and by the applicant’s country of birth. We do not state timelines. USCIS publishes current processing times on its website.
What is Form I-956F and why does it come before Form I-526E?
Form I-956F is the regional center’s application for approval of a specific investment project. Under the Act, the project is reviewed first, so that an investor’s own petition on Form I-526E can rely on a project that USCIS has already examined.
What is conditional permanent residence?
After USCIS approves the petition and a visa is available, the investor and eligible family members receive lawful permanent residence on a conditional basis for two years. Near the end of that period the investor files Form I-829 to remove the conditions.
What is Form I-829?
It is the petition to remove conditions on permanent residence. The investor shows that the investment was sustained for the required period and that the required jobs were created. USCIS decides it on its own merits.
Can family members be included?
Yes. A spouse and unmarried children under 21 can usually be included in the investor’s petition and receive the same conditional status. Your own immigration counsel confirms who qualifies in your case.
What is country of chargeability?
Visa numbers are counted against a country, which is usually the investor’s country of birth. It decides which line the case joins in the monthly visa bulletin. Rules on spouses and cross-chargeability exist; your counsel explains how they apply to you.
Working with us
Who can receive offering documents?
Eligible investors only, after a request through this website or our investor relations team and the checks required by US securities law. Offering documents are confidential and are not available for download.
Can a migration agent or advisor work with PacinfraX?
Agents and advisors who promote EB-5 projects must register with USCIS on Form I-956K before promoting a project, and must comply with US securities law. Use the interest form and tell us you are an advisor; we will reply once our counsel confirms the process.
What happens after I send the interest form?
Investor relations replies within two business days. We confirm who you are, whether you are an investor or an advisor, and what the US securities rules require before we share anything further. The form does not commit you to anything and we never ask for funds through this website.
What is shared after an agreement or NDA?
After you sign a confidentiality agreement and we complete the required checks, we can share project-level information once a project is structured. That means the confidential offering documents, the regional center filing summary and the economist’s methodology, not before.
In which languages do you work?
English controls. Every document and every statement on this website is written in English, and the English text governs if a translation differs. Translations of selected materials would follow later and would be prepared and reviewed with counsel.
How do I reach investor relations?
Write to [email protected] or use the interest form on this website. Advisors can also write to [email protected]. We reply within two business days and only from an @pacinfrax.com address.
Risks
Is a visa or permanent residence assured?
No. USCIS decides every petition on its own merits. An EB-5 investment is speculative and involves a high degree of risk, including the loss of the entire investment, and does not assure any immigration outcome.
How do I protect myself from EB-5 fraud?
Deal only with people who write from an @pacinfrax.com address, never send money in response to a message or a phone call, and read the SEC and USCIS investor alert on EB-5 scams. PacinfraX never asks for investment funds through this website.
Can an investor lose the invested capital?
Yes. Capital must be at risk during the sustainment period, which means a project can lose money, and an investor can lose the whole investment. A visa or permanent residence is not assured either. Read the offering documents with your own counsel and financial advisor.
What are the principal risks of an EB-5 investment?
Investment risk, including loss of the entire amount; immigration risk, such as a denied petition or a project that does not create the required jobs; program risk, including the September 30, 2027 sunset of the Regional Center Program; and project risk, such as delay in construction.
