The EB-5 process, step by step

A plain-language outline of how an EB-5 investment moves from first reading to the removal of conditions, based on USCIS guidance. No offering is being made on this website.

Process

Five steps from learning to removal of conditions

What unlocks the next step: Each step depends on USCIS adjudication and on the investor's own counsel.

How the steps apply to each project

These steps repeat for each project. Every project would have its own new commercial enterprise, paired with its own job-creating entity, and would select its own regional center. Read how that works on the per-project structure page.

Roles

Who does what

The forms named below are set out in the USCIS, EB-5 Questions and Answers.

Parties in an EB-5 investment and what each one does
PartyWhat they do
InvestorEngages their own counsel, documents the lawful source and path of funds, invests in the new commercial enterprise and files Forms I-526E and I-829.
Investor’s own counselAdvises on eligibility, prepares and files the immigration petitions and reviews the offering documents with the investor.
Project fund (NCE)The entity in which investors would hold their interests. Any offer would be made only through confidential offering documents to eligible investors.
Project company (JCE)Would receive capital from the project fund and build and operate the US campuses that create the jobs counted for EB-5 purposes.
Regional centerA USCIS-designated sponsor that files Form I-956F for a project. Selected for each project, with counsel.
USCISReviews Forms I-956F, I-526E and I-829, decides each petition on its own merits and publishes processing times.

Preparation

Documents investors typically prepare

This is a general outline, not legal advice. Your own immigration counsel decides what your petition needs and how each document is presented.

Documents in a language other than English usually need a certified English translation. Keep a consistent record of every transfer, from the account where the funds were earned to the final transfer into the new commercial enterprise.

  • Identity

Passports, birth certificates and any previous US immigration records.

  • Source and path of funds

Records showing how the investment funds were earned and how they moved, step by step, to the new commercial enterprise.

  • Tax and bank records

Tax filings, bank statements and other financial records that support the source of funds.

  • Family documents

Marriage certificates and the birth certificates of children who would be included in the petition.

Our role

What PacinfraX does and does not do

PacinfraX does not give immigration, legal or tax advice, does not prepare or file petitions for investors and never asks for investment funds through this website. Requests for offering documents go through the interest form. Eligible investors receive confidential offering documents only after the checks required by US securities law.

Timing

Processing times

We do not state timelines; USCIS publishes current figures for each form on its USCIS processing times page.

Program authorization

After September 30, 2027

The Regional Center Program is authorized through September 30, 2027. Reauthorization is a matter for Congress and is not assured. Investors should discuss this with their own counsel. See the USCIS, EB-5 Immigrant Investor Program page for the current status.
